These Terms of Service (the “Terms”) govern your access to and use of the Digi-Cam mobile application, websites, software, and related services (collectively, the “Service”) offered by Tazu Luisi, doing business as Digi-Cam (“Digi-Cam,” “we,” “us,” or “our”). By creating an account, accessing the Service, or using any part of the Service, you agree to these Terms and to our Privacy Policy at /privacy. If you do not agree, do not use the Service.
ARBITRATION NOTICE: Except for certain disputes described in Section 18, you and Digi-Cam agree to resolve disputes through binding, individual arbitration, and you waive any right to participate in a class action or class arbitration. See Section 18 for details, including how to opt out.
1. The Digi-Cam Service
Digi-Cam is a consumer social camera platform positioned in the app as “The Anti Social Media.” The Service may allow users to create profiles, verify phone numbers, follow accounts, discover contacts, organize friend groups or circles, share public or limited-audience posts, join or host timed Candid photo events, upload photos, videos, and other media, comment, react, tag others, send direct messages, receive notifications and Live Activities, report content or accounts, block users, and use related features we make available from time to time.
We may add, remove, suspend, or modify features at any time. Some features may be available only in certain regions, to certain users, or on certain devices. The Service is offered for personal, lawful use unless we expressly authorize a different use in writing.
2. Eligibility and Who May Use Digi-Cam
You may use Digi-Cam only if:
- you are at least 13 years old or any higher minimum age required where you live;
- you have the legal capacity to agree to these Terms;
- you are not prohibited from using the Service under applicable law, including export controls, sanctions, or other restrictions;
- your account has not previously been suspended or terminated by Digi-Cam for serious or repeated violations, unless we expressly allow you to create a new account; and
- all information you provide to us is accurate, current, and complete.
If you are under the age of majority in your jurisdiction but are old enough to use the Service, you represent that your parent or legal guardian has reviewed and agreed to these Terms where required by law.
Digi-Cam may require profile completion, date-of-birth confirmation, phone verification, or other eligibility checks before you can use certain features. You may not provide a false date of birth, phone number, or verification information.
3. Your Account
3.1 Registration and profile information
You must provide truthful registration, age, phone-verification, and profile information and keep it reasonably up to date. You may not impersonate another person, brand, or organization, or create an account in a misleading way.
3.2 Account credentials and device security
You are responsible for maintaining the confidentiality of your login credentials and for the security of the devices you use to access the Service. You are responsible for activity that occurs under your account, whether or not authorized by you, unless applicable law says otherwise. If you believe your account has been compromised, you must notify us promptly at support@digi-cam.app.
3.3 Usernames and identifiers
If you select a username, display name, or similar identifier, we may reclaim, remove, or require you to change it if we believe it is misleading, violates another person's rights, impersonates someone else, violates these Terms, or is otherwise inappropriate for the Service.
3.4 No account transfers or sales
You may not sell, license, buy, transfer, or otherwise assign your account, username, or any account credentials without our prior written consent.
4. Privacy and Data Use
Our Privacy Policy explains how we collect, use, store, and disclose information about you and your use of the Service. The Privacy Policy is incorporated into these Terms by reference.
By using Digi-Cam, you acknowledge that:
- we may process account data, phone-verification data, profile information, content, Candid event data, communications, device information, Live Activity tokens, and other data described in the Privacy Policy;
- some features may require permissions on your device, such as access to photos, camera, contacts, microphone, music libraries, or notifications;
- if you choose to use contact-discovery or friend-finding features, you authorize us to process contact information you provide for matching, subject to our Privacy Policy and applicable law;
- screen-recording and screenshot detection features, if available, are limited privacy controls and are not a guarantee that content cannot be captured or copied;
- user content, reports, metadata, and related information may be processed using automated and manual tools for safety, moderation, abuse prevention, fraud detection, security, legal compliance, and support; and
- direct messages and other communications on Digi-Cam are not represented as end-to-end encrypted unless we explicitly state otherwise in a specific feature notice.
5. Your Content and the Rights You Give Digi-Cam
5.1 Ownership of your content
You retain ownership of the text, photos, videos, audio, messages, profile information, Candid event submissions, comments, reactions, usernames where legally protectable, and other material you submit, upload, transmit, or otherwise make available through the Service (“User Content”), subject to the rights you grant in these Terms.
5.2 License to Digi-Cam
To operate the Service, you grant Digi-Cam a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to host, store, reproduce, cache, back up, process, adapt, modify, reformat, translate, transcode, compress, trim, crop, filter, create thumbnails and previews from, generate signed access links for, display, perform, distribute, transmit, and otherwise use your User Content solely as necessary to:
- provide, operate, and maintain the Service;
- make your content available to the audiences you choose through the Service;
- secure, monitor, review, moderate, investigate, and enforce our policies and legal rights;
- troubleshoot, debug, improve accessibility, improve performance, and develop or improve Service features; and
- comply with law, legal process, or governmental requests.
This license includes the right for our service providers to perform these functions on our behalf.
5.3 Duration of the license
The license above ends when your User Content is deleted from our active systems, except to the extent:
- your content has been shared, quoted, reposted, saved, or otherwise retained by other users or third parties;
- temporary backup, cache, logging, security, or disaster-recovery copies remain in the ordinary course;
- we need to retain content to investigate abuse, enforce these Terms, resolve disputes, comply with law, or protect the safety, security, and integrity of the Service or others; or
- technical limitations require additional time for deletion.
5.4 Your promises about your content
You represent and warrant that:
- you own your User Content or have all rights, consents, and permissions necessary to grant the license above;
- your User Content and your use of it on Digi-Cam do not violate these Terms, applicable law, or the rights of any person or entity, including privacy, publicity, intellectual property, and contractual rights; and
- if your User Content includes another person's likeness, voice, name, or personal information, you have all permissions required to share it.
5.5 Feedback
If you send us feedback, ideas, suggestions, or proposals regarding Digi-Cam, you agree that we may use them without restriction or compensation to you.
6. Social Features, Audience Controls, Messaging, Candids, and Expiring Content
6.1 Audience controls
Digi-Cam may allow you to choose among different audiences for content, such as public, private, self-only, limited contacts, circles, or other sharing options. We will use commercially reasonable efforts to honor the audience settings you select within the Service.
6.2 No guarantee against resharing
No audience control is perfect. People who can see your content may copy it, screenshot it, record it, reshare it, or describe it to others. Digi-Cam is not responsible for what other users or third parties do with content they can access.
6.3 Direct messages
Direct messages and similar communications are intended only for the participants selected through the Service, but they are not guaranteed to be private in every circumstance. Digi-Cam may access, preserve, review, or disclose messages and message-related information where reasonably necessary for safety, moderation, legal compliance, customer support, security, fraud prevention, or enforcement of these Terms.
6.4 Blocking and reporting
Blocking, muting, filters, and other user-control tools may reduce certain interactions but may not prevent all contact, mentions, visibility, or off-platform conduct. You may report content, behavior, or accounts that you believe violate these Terms or applicable law.
6.5 Contact discovery
If you upload or sync contacts to help find people you know, you represent that you have the right to provide the relevant contact information for that purpose and that doing so complies with applicable law.
6.6 Candids events
Digi-Cam may offer timed Candid photo events with host settings, invite links, attendee controls, event windows, reveal times, submission limits, download settings, reporting, deletion tools, and related camera flows. Some Candid camera flows may commit a photo immediately without preview, editing, or retake. You are responsible for deciding whether to participate before capturing or submitting content.
Candid photos may be locked until a reveal time, then become visible or downloadable depending on event settings and user permissions. Event invite links, including links under https://digi-cam.app/e/*, may open the app or a fallback web page. We do not guarantee that invite links, reveal timing, download controls, privacy controls, or camera limits will be uninterrupted, error-free, or impossible to bypass through screenshots, recording, or other off-platform behavior.
6.7 Expiring or temporary content
We may offer content-expiration or temporary-sharing features. Expiration settings affect how content is displayed or removed within Digi-Cam, but they do not guarantee deletion from backups, caches, logs, moderation systems, law-enforcement preservation holds, or copies made by other users or third parties.
7. Prohibited Conduct
You may not, and may not encourage or help others to:
- violate any law, regulation, court order, or third-party right;
- impersonate any person or entity or misrepresent your identity, affiliation, or authorization;
- harass, bully, threaten, stalk, abuse, exploit, extort, or intimidate anyone;
- post, transmit, or solicit content involving child sexual abuse material, sexual exploitation, non-consensual intimate imagery, trafficking, terrorism, violent extremism, credible threats of violence, or other content we prohibit;
- post hateful, discriminatory, fraudulent, defamatory, obscene, or unlawfully invasive content;
- infringe or misappropriate intellectual property, privacy, publicity, confidentiality, or other rights;
- use Digi-Cam to send spam, scams, phishing attempts, fraudulent schemes, malware, or unwanted bulk communications;
- scrape, crawl, harvest, or collect data from the Service by automated means without our prior written permission;
- use bots, scripts, fake engagement, fake accounts, or other inauthentic methods to manipulate the Service or other users;
- attempt to access accounts, data, signed URLs, media, systems, or non-public areas of the Service without authorization;
- bypass, disable, defeat, or interfere with security features, access controls, rate limits, content protections, moderation tools, or technical restrictions;
- reverse engineer, decompile, disassemble, or attempt to derive source code or underlying components of the Service except where applicable law clearly permits it despite this restriction;
- buy, sell, rent, lease, license, transfer, or trade accounts, usernames, followers, reactions, or other Service-based entitlements;
- misuse reporting, appeals, support channels, or enforcement processes, including by filing knowingly false or abusive reports;
- misuse Candid events, invite links, downloads, or event-management tools to harass others, evade audience controls, or distribute content without permission;
- use contact-discovery features with data you do not have authority to provide;
- use the Service as a general cloud-storage, archival, or backup solution;
- interfere with the normal operation of the Service or place an unreasonable burden on our infrastructure; or
- evade enforcement, including by creating replacement accounts or using alternative identities after restriction or suspension.
8. Safety, Moderation, and Enforcement
8.1 Our right to moderate
Digi-Cam may, but is not obligated to, monitor, review, screen, flag, block, blur, label, limit, reject, remove, or disable content, accounts, messages, profile changes, media uploads, Candid events or photos, comments, circles, reactions, Live Activities, notifications, or other activity if we believe it may violate these Terms, our policies, applicable law, or the safety, security, integrity, or reputation of the Service or its users.
8.2 Automated and manual review
We may use local checks, automated systems, human reviewers, and third-party service providers to detect spam, fraud, abusive behavior, policy violations, illegal activity, or unsafe content. This may include review of profile text, posts, comments, direct messages, images, videos, Candid photos, and related metadata. Moderation and safety systems can make mistakes, and no system is perfect.
8.3 Enforcement actions
Enforcement steps may include, without limitation:
- warning you;
- removing or limiting distribution of content;
- disabling specific features;
- rejecting profile or media changes;
- removing, locking, or disabling Candid events, photos, invites, or downloads;
- restricting messaging or visibility;
- deleting content, including media that violates our rules or fails moderation review;
- suspending or terminating your account;
- preserving records or content relevant to investigations, disputes, or legal obligations; and
- reporting information to law enforcement, regulators, rights holders, or other appropriate parties where we believe doing so is required or appropriate.
8.4 No promise of notice
Where permitted by law, we may take enforcement action with or without prior notice. In some cases, we may offer a way to appeal or request review, but we are not obligated to do so in every case.
9. Intellectual Property and Copyright Complaints
9.1 Digi-Cam's intellectual property
The Service, including its software, code, design, text, graphics, logos, interfaces, audiovisual elements, compilations, and all related intellectual property other than User Content, is owned by Digi-Cam or its licensors and is protected by applicable intellectual property laws.
9.2 Limited license to you
Subject to your compliance with these Terms, Digi-Cam grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial use.
9.3 Restrictions
Except as expressly allowed by us in writing or by non-waivable law, you may not copy, modify, distribute, sell, lease, publicly display, publicly perform, republish, or create derivative works from the Service or Digi-Cam's content.
9.4 Copyright complaints
If you believe content on Digi-Cam infringes your copyright or other intellectual property rights, please send a notice to legal@digi-cam.app with sufficient detail for us to investigate, including your contact information, identification of the allegedly infringing material, identification of the work claimed to be infringed, and a statement made under penalty of perjury where required by law. We may remove content, disable access, or terminate repeat infringers where appropriate. Non-IP reports can be sent through in-app report controls or to reports@digi-cam.app. Urgent safety issues can be sent to safety@digi-cam.app.
10. Third-Party Services, Devices, and App Stores
The Service may depend on or interoperate with third-party products and services, including Supabase Auth, Supabase Postgres, Supabase Storage, Supabase Realtime, Supabase Edge Functions, Apple, Google Sign-In, Google Video Intelligence, OpenAI moderation services, APNs, ActivityKit, WidgetKit, Resend, device operating systems, push-notification services, analytics tools, payment processors, music or media APIs, app stores, and other vendors. Digi-Cam does not control and is not responsible for third-party products or services except as required by law.
Your use of third-party products or services may be subject to separate terms and privacy policies from those third parties. Digi-Cam is not liable for third-party acts, omissions, interruptions, or security failures.
Apple-specific terms (for iOS users)
If you obtained the Digi-Cam app from Apple's App Store:
- the license granted to you is limited to use on Apple-branded products you own or control and as permitted by the App Store terms;
- Apple has no obligation to provide maintenance or support services for the app;
- Apple is not responsible for addressing claims relating to the app, including product liability, legal compliance, or consumer-protection claims;
- Apple is not responsible for the investigation, defense, settlement, or discharge of third-party intellectual property claims relating to the app; and
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms as they relate to your license to use the app.
11. Service Availability, Changes, and Future Features
We do not guarantee that the Service, or any part of it, will always be available, secure, error-free, or uninterrupted. Features may malfunction, messages may not be delivered, notifications or Live Activities may be delayed, invite links may fail, uploads may fail, and content may become unavailable.
We may change, suspend, discontinue, or impose limits on any aspect of the Service at any time, including storage limits, media formats, eligibility rules, and feature availability. We may also offer beta or experimental features, which may be subject to additional terms and may be withdrawn at any time.
Unless we expressly state otherwise, Digi-Cam is not a backup or archival service, and you are solely responsible for maintaining copies of content you want to keep.
12. Paid Features
Unless we expressly offer paid products, subscriptions, digital goods, or other paid features, Digi-Cam is currently made available without charge. If we introduce paid features in the future, additional billing, renewal, refund, cancellation, and payment terms may apply and will be presented to you at the time of purchase.
13. Suspension, Termination, and Deletion
13.1 Your right to stop using Digi-Cam
You may stop using the Service at any time. You may request deletion of your account through the Service or by contacting legal@digi-cam.app, subject to any verification procedures we require.
13.2 Digi-Cam's right to suspend or terminate
We may suspend, restrict, or terminate your access to all or part of the Service at any time if:
- you violate these Terms or our policies;
- we reasonably believe your conduct creates risk, legal exposure, or harm to users, third parties, or Digi-Cam;
- we are investigating suspected misconduct;
- we are required to do so by law or legal process; or
- we discontinue the Service or a feature.
13.3 Effect of termination
Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination will survive, including sections relating to ownership, licenses where still applicable, dispute resolution, disclaimers, limitations of liability, indemnity, and enforcement rights.
13.4 Residual copies and retained information
Deletion of an account or content may not be immediate or complete in every system. Copies may remain for a limited period in backups, caches, logs, moderation records, legal holds, fraud-prevention systems, and records needed for safety, dispute resolution, or compliance.
14. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” DIGI-CAM DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
DIGI-CAM DOES NOT WARRANT THAT:
- the Service will be uninterrupted, timely, secure, or error-free;
- content will be preserved, retrievable, or delivered;
- any audience restriction, block, mute, or privacy setting will be perfectly effective;
- screenshot, screen-recording, privacy-shield, download, invite, or reveal controls will prevent every capture, copy, disclosure, or timing issue;
- any moderation, safety, or detection measure will be accurate or complete; or
- content made available through the Service will be lawful, accurate, or appropriate.
To the maximum extent permitted by law, Digi-Cam is not responsible for the conduct of users, third parties, or third-party services, whether online or offline.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGI-CAM AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGI-CAM'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
- US $100, or
- the amount you paid Digi-Cam, if any, in the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you. In those jurisdictions, Digi-Cam's liability will be limited to the greatest extent permitted by law.
16. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Digi-Cam and its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against any claims, demands, actions, liabilities, damages, losses, judgments, settlements, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
- your User Content;
- your use of the Service;
- your violation of these Terms or applicable law; or
- your infringement or violation of any rights of another person or entity.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with us in that defense.
17. Governing Law
These Terms and any dispute arising out of or relating to these Terms or the Service will be governed by the laws of California, United States, without regard to conflict-of-law principles, except to the extent preempted or displaced by applicable consumer-protection law.
18. Dispute Resolution; Arbitration; Class Action Waiver
18.1 Informal resolution first
Before either party files a claim, the party must send the other a written notice describing the dispute, the requested relief, and the basis for the claim. Notices to Digi-Cam must be sent to legal@digi-cam.app. We will send notices to the contact information associated with your account or other reasonable contact information we have for you. If a dispute is not resolved within 30 days after notice is received, either party may proceed as allowed below.
18.2 Binding arbitration
Except for matters that may be brought in small claims court or for claims seeking injunctive or equitable relief for misuse of the Service, unauthorized access, or intellectual property infringement, you and Digi-Cam agree to resolve disputes by binding, individual arbitration administered by the American Arbitration Association (“AAA”) under its applicable consumer arbitration rules.
18.3 No class actions
You and Digi-Cam agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, representative, or private attorney general proceeding. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that party's individual claim.
18.4 Small claims option
Either party may bring an eligible claim in small claims court on an individual basis, so long as the claim remains in that court and proceeds only on an individual basis.
18.5 Opt-out right
You may opt out of this arbitration agreement by sending a written opt-out notice to legal@digi-cam.app within 30 days after you first agree to these Terms. Your notice must include your full name, account identifier, contact information, and a clear statement that you want to opt out of arbitration.
18.6 Venue for non-arbitrable disputes
If a dispute is found not subject to arbitration, or if arbitration is unenforceable for a particular claim, then unless applicable law requires otherwise, that dispute must be resolved exclusively in the state or federal courts located in San Mateo County, California, United States, and you and Digi-Cam consent to personal jurisdiction there.
18.7 Jury-trial waiver
To the extent a dispute proceeds in court rather than arbitration, you and Digi-Cam waive any right to a jury trial, unless such waiver is prohibited by law.
19. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice as required by law, which may include notice in the app, on our website, by email, or by other electronic means. The updated Terms will become effective on the date stated in the revised Terms. By continuing to use the Service after the updated Terms become effective, you agree to the revised Terms. If you do not agree, you must stop using the Service and, if you wish, delete your account.
20. General Terms
20.1 Entire agreement
These Terms and the Privacy Policy, together with any additional terms expressly presented to you for specific features, form the entire agreement between you and Digi-Cam regarding the Service.
20.2 Severability
If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect.
20.3 No waiver
A failure by Digi-Cam to enforce any provision of these Terms is not a waiver of our right to do so later.
20.4 Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. Digi-Cam may assign these Terms, in whole or in part, including in connection with a merger, acquisition, sale of assets, corporate reorganization, or by operation of law.
20.5 Electronic communications
You agree to receive electronic communications from us regarding the Service, your account, security issues, legal notices, and other matters. You agree that electronic notices satisfy any legal requirement that such notices be in writing.
